New I-9 Forms

The USCIS has issued an interim final rule to streamline the Employment Eligibility Verification (Form I-9). Employers must begin using new I-9 form on February 2, 2009. The form will be available on the USCIS website (http://www.uscis.gov) before that date. The interim final rule makes the following changes to current I-9 rules:

Expired documents are no longer considered acceptable for proof of identification or work authorization.

The following former List A documents: Temporary Resident Card and older versions of the Employment Authorization Card / Document are no longer acceptable.

Foreign passports containing special machine-readable visas for certain citizens of the Federated States of Micronesia (FSM) and the Republic of the Marshall islands (RMI) and the new U.S. Passport Card are added to List A.

The employee attestation section of the form is revised.
